Rules, Regulations, & Other Terms
Indisputable, Nonrefundable Payments and Cancellation Policy
Guest knowingly and voluntarily waives the right to dispute any and all credit/debit card charges pertaining to the rental, including associated service fees and/or damages. Any conflict regarding these charges shall be resolved through arbitration in Maricopa County, Arizona.
All reservation fees are nonrefundable and the reservation cannot be cancelled for any reason, including but not limited to natural disasters, acts of God, pandemics, resort closures, grounded or cancelled flights, sudden illness, accidents, or death in the family, unless a Cancellation Waiver is purchased under the terms below.
At booking, Guest was offered an optional Cancellation Waiver (8% of the reservation value plus taxes and fees). The waiver may be purchased at booking and up to 30 days prior to arrival. Within 30 days of arrival, reservations without the waiver are non-changeable and nonrefundable. If purchased, the waiver will appear in the itemized charges. For third‑party bookings, Guest must contact Management directly to add the waiver.
To invoke the waiver, Guest must notify Management at least 48 hours prior to the day of check‑in by both phone and email. If calls are not answered, Guest must leave a voicemail and send an email including the time and date of the voicemail, reservation details (arrival day, confirmation number, reservation name, and property), and the request to enforce the waiver. Failure to provide timely notice voids the waiver.
If properly invoked, Management will refund the cost of the reservation minus the waiver cost by credit/debit card within 5–7 business days or by check within 30 days. Management strongly encourages purchase of the Cancellation Waiver; when purchased, it provides reimbursement for prepaid amounts (less the waiver cost) that would otherwise be completely non-changeable and nonrefundable.
Reservations
All reservations are subject to Management and property owner approval. Online rates are subject to change without notice. If there are any issues with the reservation, Guest will be contacted within 48 hours.
Unavailability
If the reserved unit becomes unavailable for reasons beyond Management’s control (including failure of basic property structure that compromises safe habitability), Management may, with Guest’s approval, substitute a comparable unit. If no comparable unit is offered or Guest does not approve, this Agreement shall be void and Management shall refund all payments in full. By electing to void this Agreement, Guest waives all claims arising out of this Agreement.
Unforeseen Occurrences
Guest assumes all risks arising from occurrences not under Management’s control. Management will not be liable for loss, damage, or inconvenience caused by weather, natural disasters, pandemics, pests, construction, public/private events, acts of God, wildfire/smoke, road closures, interruptions of services/utilities, travel restrictions, or facility closures issued by public authority.
Strict Noise Ordinance
Scottsdale City and certain HOAs enforce strict noise ordinances. Loud noises, music, and/or loud vehicle noises are prohibited between 10:00 pm and 7:00 am. Violations may result in fines, eviction of Guest and all occupants/visitors, and forfeiture of all rent and security deposit.
Security Deposit / Damage Waiver
A valid credit card must be kept on file before, during, and after the reservation. Guest may have the option of a damage waiver or a deposit. The Damage Waiver covers accidental damages reported during the stay up to the stated limit on the reservation breakdown. Damages exceeding coverage, unreported damages, missing items, excessive cleaning, fines, and costs to remove Guest from the property may be charged to the card on file. Guest consents to such charges.
Cleaning
Premises will be delivered professionally cleaned. A mandatory, nonnegotiable, and nonrefundable Cleaning Fee is charged at booking. Excess cleaning required due to Guest’s use will be charged to Guest.
Amenities
A complimentary starter pack may include paper towels, dishwasher tablets, trash bags, dish soap, hand soap, shampoo, conditioner, body lotion, toilet paper, detergent, and basic condiments. Guest is responsible for purchasing any additional items needed during the stay.
Pets
Pets are not allowed unless specifically pre‑authorized via a signed pet addendum. Unauthorized pets at non‑pet‑friendly properties will incur a $2,000 fee plus necessary cleaning costs and may result in immediate eviction and forfeiture of rent.
Service animals trained to perform tasks for a disability are accommodated in accordance with applicable law. Guests requesting an accommodation should do so in writing at the time of booking and state the specific work or task the animal has been trained to perform. Guests are responsible for any damages or additional cleaning caused by a service animal. Emotional support animals are only permitted in properties that allow pets.
No Smoking
Smoking is prohibited anywhere on the premises. Guest is responsible for all smoke‑related damages, odors, debris removal, and any losses from future cancellations due to smoke complaints. Management may charge the card on file for amounts exceeding any waiver or deposit. Discovery of smoking during the stay may result in eviction and forfeiture of rent and deposit.
Condition of Premises
Upon arrival, Guest shall examine the premises (including furniture, furnishings, appliances, fixtures, and landscaping) and immediately report in writing any non‑operating condition or disrepair. Such reports do not grant a right to cancel or refund.
Nearby Construction
Construction near the property may occur and is governed by local rules outside Management’s control. Management will use best efforts to notify appropriate parties if it learns of potential violations. No refunds will be given for construction activity.
Lost or Left Items
Guest is solely responsible for lost, stolen, or abandoned items. Management assumes no responsibility. If items are found, Management may attempt to contact Guest. Return shipping plus a $25 handling fee apply. Items unclaimed after 30 days may be donated or sold. Firearms or illegal substances found after departure will be turned over to authorities.
Shipping
Guest may ship items to Management’s secure facility for $10 per package (charged to the card on file). Management assumes no liability for shipped items. Delivery to Guest may take up to 24 hours after receipt. Perishable and time‑sensitive shipments are not recommended. Management’s approved shipping label format must be used; contact Management for label and address details. Packages received after departure will incur return shipping charges plus a $25 handling fee.
Maximum Occupancy
The property is for personal vacation use by approved guests only. No more than the maximum occupancy specified in the Rental Agreement may stay overnight. A $250 per‑person, per‑night charge applies to each unapproved guest and may be assessed without notice. Violations may result in immediate termination, eviction, forfeiture of rent and deposit, and additional charges.
No Parties
Events such as weddings, receptions, parties, or other large gatherings are prohibited. Disruptive events may result in immediate termination, eviction, and forfeiture of rent and deposit.
Fireworks
Fireworks are prohibited. Guest is liable for all damages resulting from fireworks use on or around the property.
Illegal Substances
Illegal substances are prohibited, including minors possessing alcohol. Violations may result in eviction and forfeiture of rent and deposit.
TV / Cable / Internet / Satellite
Any provided subscription services are conveniences only and not integral to this Agreement. Outages, access issues, content preferences, speed, or lack of knowledge of use do not warrant refunds.
Air Conditioning / Heating
Some properties may not have air conditioning. Where available, AC shall not be set below 72°F and heat shall not be set above 78°F. Fan settings must remain on “Auto,” and all doors/windows must be closed while HVAC is operating. No refunds for lack or malfunction of HVAC.
Pool and Spa
Not all properties have pools or spas and such areas may not be fenced or secured. Use is at Guest’s own risk. Guest is responsible for damages to pools, spas, or support equipment due to misuse or negligence.
Systems Failures
Owner and Management are not liable for damages from failures of water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilation, pool, spa, or structural systems. Management will make reasonable efforts to repair or replace failed systems and may access the property as needed. No refunds are given for system failures.
Rules, Regulations, and No Commercial Use
Guest shall comply with all posted or delivered rules and regulations and shall ensure that visitors and licensees do the same. Guest shall not disturb neighbors; use the premises for commercial or unlawful purposes; violate any law; commit waste or nuisance; or violate any HOA rules. Applicable HOA rules are provided in pre‑check‑in communications. Violations may result in eviction and forfeiture of rent and deposit.
Maintenance and Reporting
Guest shall properly use, operate, and safeguard the property, including landscaping, furniture, furnishings, appliances, and mechanical/electrical/gas/plumbing fixtures. Keep the property clean and sanitary, and immediately report problems, malfunctions, or damage. Guest is liable for repairs or replacements caused by Guest (excluding ordinary wear and tear) and for damages resulting from delayed reporting.
Entry
Management and its representatives may enter the property at any time:
- To make necessary or agreed repairs, alterations, improvements, maintenance, or to supply services;
- To verify compliance with this Agreement; or
- In case of emergency.
With at least 24 hours’ reasonable notice, Management may also enter to show the premises to prospective or actual purchasers, tenants, mortgagees, lenders, appraisers, or contractors.
Parking
Scottsdale City and certain HOAs have strict parking rules. Street parking may be prohibited year‑round. Violations may result in ticketing or towing at Guest’s sole expense. Management is not liable for costs or damages arising from parking violations.
Termination of Occupancy
Upon termination of occupancy, Guest shall:
- Return all keys and access/opening devices (including garage and common areas);
- Vacate and surrender the premises of all persons and possessions at the agreed time;
- Vacate any parking and/or storage spaces; and
- Deliver the premises in the same condition as received, less ordinary wear and tear.
Mediation
Guest agrees to mediate any dispute or claim arising out of this Agreement before resorting to arbitration or court action. Mediation fees, if any, are shared equally among the parties.
Venue and Choice of Law
This Agreement is governed by the laws of the State of Arizona and Maricopa County. Maricopa County shall have personal jurisdiction over the parties, and the county in which the premises are located shall be the forum for any legal action.
Entire Contract
Time is of the essence. This Agreement constitutes the entire contract and incorporates all prior agreements. It is the complete and exclusive statement of its terms; no extrinsic evidence may be introduced to contradict it. Invalid provisions do not affect remaining terms. A waiver of any breach is not a continuing waiver.
Insurance and Indemnification
- Owner Insurance: Guest’s personal property (including vehicles) is not insured by Owner, Management, or any HOA against loss or damage from fire, theft, vandalism, water, criminal/negligent acts of others, or other causes. Owner/Management do not insure against personal injury to Guest, visitors, or licensees except as caused by the condition of the premises.
- Renter Insurance: Management recommends Guest obtain insurance to protect persons and personal property.
- Indemnity and Hold Harmless: Guest agrees to indemnify, defend, and hold harmless Owner, Management, and their affiliates from all claims, disputes, judgments, costs, and attorney fees arising from loss, damage, or injury to Guest, visitors, licensees, or their property. Guest releases Owner/Management and their affiliates from liability for personal injury, death, property damage, or other loss to the fullest extent allowed by law.
Joint and Individual Obligations
If more than one Guest is named, each is jointly and individually responsible for all obligations under this Agreement.
